ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.01.2026 for the alleged offences under Sections 296(b), 329(3), 115(2), 118(1) and 109 of B.N.S. in Crime No.14 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the 1st accused developed illegal intimacy with the victim's wife and when the same was challenged by the victim, wordy quarrel arose between the victim and the accused and the 1st accused along with petitioners and other accused, had attacked the victim with riper stick and caused injury to him. Hence, this case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent, that according to the prosecution, the petitioner along with his parents, attacked the victim with riper stick, due to which, sustained injury. The injured person was discharged from the hospital. He would further submit that the petitioner has been falsely implicated in this case. Therefore, he prays to enlarge the petitioner on bail.

Whereas the learned Government Advocate (Criminal side) appearing for the respondent police would submit that due to the severe injury, the injured was hospitalized for more than 10 days and therefore, if the petitioner is enlarged on bail, it would cause negative impact in the village and hence strongly opposed to enlarge the petitioner on bail.

5. The very submission made by the learned Government Advocate is reasonable. Therefore, this Court is of the opinion that it is not desirable to enlarge the petitioner on bail at this time.
