i] To divide the plant schedule mentioned properties into 2 equal shares and to allot one such share to the plaintiff by metes and bounds and put the plaintiff under separate possession and enjoyment of her respective share through process of law:

ii] To appoint an Advocate/Commissioner to effect the partition iii] for a permanent injunction against the defendant restraining him and his men and agents from making any kind of encumbrance over the schedule mentioned properties or making any kind of alteration/construction work in the schedule mentioned properties;

J U D G M E N T

This suit has been filed for partition and separate possession and for permanent injunction to restrain the defendant from making any encumbrance, alteration or construction in the suit schedule properties and and for costs.

2. When the matter is taken up today, the learned counsel for the 2/4

plaintiff and the defendant submitted that the parties have entered into a memorandum of compromise and the suit may be decreed in terms of the Memorandum of Compromise entered between the parties. The plaintiff and defendant are also present before this Court and they also admitted the memorandum of compromise entered between them.

3. Accordingly, this suit is decreed in terms of Memorandum of Compromise entered between the parties. The Memorandum of Compromise dated 08.01.2024 executed between the parties form part of the decree. Consequently, the connected application is closed. 08.01.2024 vrc 3/4
