ORDER

This writ petition has been filed seeking for a direction to the respondents to cancel Patta No.2604 standing in the name of the respondents 7 to 10 in respect of the property more fully disclosed in the prayer to the writ petition and consequently, to issue separate patta in favour of the petitioner for the very same property based on the petitioner's representation, within a time frame to be fixed by this Court.

The petitioner claims that respondents 7 to 10 unlawfully and illegally have obtained Patta No.2604 for the property more fully disclosed in the prayer to this writ petition. The petitioner therefore seeks cancellation of the said patta standing in the name of the respondents 7 to 10. The petitioner had given a representation seeking cancellation of Patta No.2604. Since the said representation was not considered, the petitioner has filed this writ petition. The competent authority to cancel the patta is the 3rd respondent. As the earlier representation of the petitioner was not duly acknowledged by the 3rd respondent, the petitioner will have to give a fresh representation.

The learned counsel for the petitioner, on instructions, would submit that the petitioner is willing to submit a fresh representation to the 3rd respondent seeking cancellation of Patta in Patta No.2604 standing in the name of the respondents 7 to 10 and that a direction may be issued to the 3rd respondent to consider such representation on merits and in accordance with law, after hearing the objections of respondents 7 to 10, within a time frame to be fixed by this Court.

4. Mr.R.P.Murugan Raja, learned Government Advocate, accepts notice on behalf of the respondents. Since no adverse orders are passed against the respondents 7 to 10, notice to them in this writ petition is dispensed with.

5. No prejudice will be caused to any other parties, if the aforesaid direction is issued by this Court. This Court is not expressing any opinion on the merits of the aforesaid representation of the petitioner.

For the foregoing reasons, this writ petition is disposed of by directing the petitioner to submit a fresh representation to the 3rd respondent seeking cancellation of Patta No.2604 standing in the name of respondents 7 to 10 for the property more fully described in the prayer to this writ petition, within a period of twelve weeks from the date of receipt of a copy of this order.

On receipt of the said representation within the stipulated time, the 3rd respondent shall pass final orders on merits and in accordance with law, after hearing the objections of the respondents 7 to 10 and any other interested 3rd parties, whom the 3rd respondent deems fit to enquire into, within a period of twelve weeks thereafter. No Costs.
