ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under sections 379 & 430 r/w section 21(1) of Mines and Minerals (Development & Regulation) Act in Crime No.209 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The petitioner is the owner of the lorries, in which 2units of river sand each in three lorries were illegally transported without any valid permission from the concerned authority.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any such offences as alleged by the prosecution. He further submitted that he has been falsely implicated in this case. Hence, he pleads for anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent raised objection for granting anticipatory bail to the petitioner stating that absconding charge sheet has been filed against the petitioner herein.

5. In the light of the above fact, this Court is not inclined to grant anticipatory bail to the petitioner.
