O R D E R

This writ petition has been filed for the issue of writ of mandamus directing the respondents 2 & 3 to act upon the application submitted by the petitioner seeking for survey of the subject property and for demarcation of the boundaries.

2.Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents 1 to 3. 3.The grievance of the petitioner is that the 4th respondent had submitted an application for survey and even without issuing notice to the petitioner, the survey was conducted in a hasty manner. Hence, the petitioner wanted a re-survey to be conducted and he submitted an online application along with the necessary charges. When the revenue authorities attempted to survey the property, it was resisted by the 4th respondent and therefore, the survey was not conducted. Subsequent 2/5

representation made by the petitioner also did not evoke any response. It is under these circumstances, this writ petition came to be filed before this Court.

4.The learned counsel for the petitioner submitted that the petitioner has challenged the present and the earlier survey that was conducted without putting the petitioner on notice and therefore, the petitioner wanted re-survey to be conducted. In spite of the handicap faced by the petitioner, he was made to run from pillar to post. 5.Taking into consideration the facts and circumstances of the case and the materials placed before this Court and taking note of the submissions made on either side, there shall be a direction to the respondents 2 & 3 to act upon the application submitted by the petitioner on 16.04.2024 and conduct a survey in the subject property in the presence of respondents 4 & 5 based on the title documents relied upon. This process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order.

6.In the result, this Writ Petition is disposed of with the above directions. No costs.
