Respondents Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to direct the XVIII Metropolitan Magistrate, Saidapet, Chennai to consider the application of the petitioner for granting permission to travel abroad and for the purpose of renewal of the petitioner's passport bearing No.J4490193 pending on the file of the second respondent vide reference No.TR1073174460320 dated 23.12.2020 on the same day of presentation being made by the petitioner.

ORDER

This petition has been filed seeking direction to the learned XVIII Metropolitan Magistrate, Saidapet, Chennai to consider the application of the petitioner for granting permission to travel abroad and for the purpose of renewal of the passport of the petitioner.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) for the first respondent.

3. The petitioner due to matrimonial dispute, is facing civil as well as criminal proceedings. The validity of the passport of the petitioner is to shortly expire. Therefore, the petitioner seeks renewal of the passport and he also wants leave of the court to go abroad.

4. The learned counsel for the petitioner states that since https://hcservices.ecourts.gov.in/hcservices/

there is no regular Magistrate posted for the jurisdictional Court, the petitioner's application is not likely to be taken up and that made him to file this petition invoking inherent powers of the Court.

5. Taking note of the overall facts and circumstances, I direct the learned XVIII Metropolitan Magistrate, Saidapet, Chennai to consider the petitioner's petition mentioned application and dispose it of on merits and in accordance with law within a period of one week from the date of filing of the petition.

6. This Criminal Original Petition is disposed of accordingly.
