Mr.S.Ravichandran, Additional Government Pleader (HR & CE) Order The writ petition is filed to direct the 1st respondent to consider petitioner's complaint to take appropriate action in accordance with law against the 2nd respondent for having submitted a false report dated 4.5.2023.

Case of the petitioner is that he is maintaining Sri Nithya Kalyana Perumal Temple, comprised in S.F.No.97, situated at Peerkankaranai Village, Tambaram Taluk, Chengalpattu District, through his Trust namely Sree Nidhya Kalyanaperumal Alaya Seva Trust. While so, certain private individuals interfering with his peaceful performance of administration of the temple. Hence, he filed a Suit in O.S.No.90 of 2020 on the file of the learned District Munsif court, Tambaram, for bare injunction. During the pendency of the Suit, on complaint from the said private individuals, the 2nd respondent submitted a report falsely alleging that the petitioner had encroached an extent of 4140 sq.ft of temple land and constructed a house. Aggrieved by the said report, the petitioner has made a complaint against the 2nd respondent and to set aside the said report. Despite his written complaint, the 1st respondent has failed to take any action. Hence this petition.

Learned counsel appearing for the petitioner submitted that the petitioner's residential house is situated adjacent to the temple land and without any proper verification of boundaries, the 2nd respondent has falsely alleged that the petitioner had encroached the temple land. He further submitted that since the issue involved is challenged before the Civil Court in O.S.No.90 of 2020 on the file of the learned District Munsif court, Tambaram, for bare injunction, the learned counsel for the petitioners restricted his prayer and sought permission of this Court to grant liberty to the petitioner to canvass all his grievances before the competent civil Court.

4. Mr.S.Ravichandran, learned Additional Government Pleader (HR&CE) who takes notice for the contesting respondent has no objection for such an order being passed by this Court.

5. Heard the respective counsel appearing on either side and perused the materials placed on record.

6. In the light of the submission made by the learned counsel for the petitioner, this Court grants liberty to the petitioner to canvass all his grievances before the competent civil Court in a manner known to law.
