ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.02.2026 for the alleged offences under Sections 75 and 33 of Juvenile Justice Act 2015 and Section 109 of B.N.S. in Crime No.2 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that due to the family dispute between the petitioners, who are the husband and wife, the 1st petitioner had brutally beaten the 8 months old child. Based on the complaint given by the District Child Protection Officer, this case has been registered.

3. The learned counsel appearing for the petitioners would submit that there was family dispute between the husband and wife and that they are under incarceration since 05.02.2026 and that they are ready to abide by any condition that may be imposed by this Court and prays to enlarge the petitioners on bail.

4. The learned Government Advocate (Criminal side) strongly objected to enlarge the petitioners on bail and he has shown the videographs before this Court, which shows that how brutally the petitioners have treated the 8 months old child..

5. From the submissions made by the learned Government Advocate, this

Court is of the view that if the petitioners are enlarged on bail, that would definitely endanger the life of the baby and therefore, this Court is not inclined to enlarge the petitioners on bail.

6. Accordingly, this Criminal Original Petition is dismissed. 06-03-2026 MJS Note:
