Seeking leave to file suit for the items of suit properties which situate beyond the territorial jurisdiction of this Court, the applicant/plaintiff has come up with this application. 2.The suit is laid for preliminary decree for partition and separate possession.

3.Learned counsel for the applicant submitted that several items of suit properties situate within the jurisdiction of this Court and only item II of the suit schedule property situates outside the jurisdiction. To avoid multiplicity of proceedings, leave is necessary to file single suit in respect of all the items of suit properties, the learned counsel contended.

4.Considering the submissions made by the learned counsel for the applicant and taking note of the averments made in the plaint, leave is granted.
