The relief sought for in this writ petition is to direct the respondents to call the petitioner for certificate verification for the post Graduate Assistants/Physical Education Directors Grade-I in Economics and in the event of fulfilment of all requirements, issue appointment order to the petitioner for the post of Post Graduate Assistants/Physical Education Directors Grade-I.
2. The grievance of the writ petitioner is that he is fully qualified and eligible for appointment to the post of Post Graduate Assistant / Physical Education Directors Grade-I. The petitioner participated in the process of selection and he secured 86 marks. The petitioner is fully qualified and eligible to the post. The petitioner is falling under the category of SC (General) and therefore, he claims that he is entitled for appointment in the said post of Post Graduate Assistant. https://hcservices.ecourts.gov.in/hcservices/
3. The learned Government Advocate appearing on behalf of the respondents brought to the notice of this Court that admittedly, the petitioner secured 86 marks in the selection. However, the last cut off marks fixed for the category of SC (General) was 88 marks. Thus, the petitioner was not within the zone of consideration.
4. This Court is of an opinion that when the petitioner is not within the zone of consideration, he cannot seek the relief of appointment by filing the present writ petition. Thus, the writ petition is devoid of merits and stands dismissed. However, there shall be no order as to costs.
