Petition praying that in the circumstances stated therein the High Court will be pleased to [I] Modify the Bail Condition that one of the Surety should be a blood relative in the above Crl.O.P.No.16383 of 2017 dated 14.09.2017 in the above Cr.No.114 of 2017 on the file of this Honble Court,[IN CRL.MP.NO.13064 OF 2017] [II] extend the time for furnishing sureties the above Crl.O.P.No.16383 of 2017 dated 17.09.2017 in the above Cr.No.114 of 2017 on the fiel of this Honble Court. [IN CRL.MP.NO.13065 OF 2017] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.M.RAJAVELU, Advocate [IN ALL THE PETITIONS] for the petitioner and of PUBLIC PROSECUTOR [IN ALL THE PETITIONS]on behalf of the Respondent the court made the following order:- Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondent-State. 2.
This Court, on 14.09.2017, has granted anticipatory bail to the petitioner on certain conditions, one of which reads as follows:
" the petitioner shall execute the bond for a sum of Rs.10,000/- with two sureties, out of whom, one shall be a blood related surety, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned"
3. Learned counsel for the petitioner seeks modification of the aforesaid condition with a supporting affidavit containing that he has no blood relatives to stand as a surety and his wife is willing to stand as a surety for him.
4. Accepting his submission, the condition imposed in the order dated 14.09.2017 is modified to the effect that instead of one blood related surety, the wife of the petitioner can stand as a surety for him. Rest of the conditions imposed in the order dated 14.09.2017 shall remain the same. Two weeks time is granted from the date of receipt of a copy of the amended modified order for furnishing sureties.
