ORDER
This Criminal Miscellaneous Petition has been filed to cancel the anticipatory bail granted to the 1 st respondent herein in Crl.OP No.20295 of 2024 dated 29.08.2024 on the file of this Hon'ble Court. 2.This Court, while granting bail to the 1 st respondent had imposed a condition that he shall deposit a sum of Rs.4,00,000/- (Rupees Four lakh only) to the credit of Crime No.27 of 2023 within a period of two weeks from the date of receipt of a copy of this order and shall produce the said receipt before the Court below and on such deposit, the defacto complainant is permitted to withdraw the same on filing of undertaking affidavit and proper identification and acknowledgment; and he shall report before the concerned police on every Tuesday and Saturday at 10.30 a.m., for a period of three months and thereafter, as and when required for interrogation. The above said conditions has not been complied by the 1 st respondent. Hence, the present petition has been filed for canceling the anticipatory bail.
3.This Court, ordered notice to the 1 st respondent and though private notice was served and his name is printed in the cause list, but he has not entered appearance.
4.The learned counsel for the petitioner submitted that the respondent police have not taken any steps to arrest the 1 st respondent/5 th accused even
though he has neither come forward to execute the sureties and nor paid the money.
5.The learned Government Advocate (Crl.side) for the 2 nd respondent police submitted that the 1 st respondent has not complied with the condition and has also not appeared before them.
6.Considering the same, this Court is of the view that the 1 st respondent has wilfully not obeyed the condition imposed by this Court in para No.6 (a) and (c) in Crl.OP No.20295 of 2024 dated 29.08.2024.
7. Accordingly the anticipatory bail granted by this Court in Crl.OP No.20295 of 2024 dated 29.08.2024 is cancelled. Accordingly, this Miscellaneous Petition is allowed.
