O R D E R

This Criminal Original Petition has been filed to direct the respondents, particularly to the 2nd respondent to comply the order dated 05.01.2018 passed in CRP. No.14 of 2017, on the file of Additional Sessions Judge (Fast Track), Arni to complete the investigation by filing a final report.

2. The learned Counsel appearing for the petitioner would submit the petitioner is an agriculturist and is having 6 acres of land; after harvest he kept nearly 21 bags of paddy with him; On 02.05.1999, 6 persons took away all the 21 bags of paddy. Therefore, petitioner lodged a complaint before the 2nd respondent police. The 2nd respondent police registered a case in FIR No.380 of 2007.

The learned Counsel for the petitioner further submitted that the petitioner has approached the Judicial Magistrate Arni by filing RCS No.20 of 2008, but the same was dismissed on 30.06.2008, against which, the petitioner has filed Criminal Revision Petition before the District Judge in CRP No.9 of 2011, which was subsequently transferred to the Additional District Sessions Judge (Fast Track Court), Arni. After considering the facts and circumstances, the Additional District Sessions Judge (Fast Track Court), Arni has directed the 2nd respondent to complete the investigation after following the criminal procedure and to complete the same within six months from the date of order. But no action has been taken by the 2nd respondent police till now. Hence the present petition has been filed by the petitioner.

4. Considering the facts and circumstance of the case, the 2nd respondent is directed to comply with the order dated 05.01.2018 passed in CRP. No.14 of 2017, on the file of Additional Sessions Judge (Fast Track), Arni within a period of two months from the date of receipt of a copy of this order.

5. With the above direction, this Criminal Original Petition is disposed of.
