ORDER

The main issue raised in this writ petition is that the petitioner having registered for the viva voce examination for the Studio course in semester-IV for Architectural Design-III, was not able to attend the exam due to a situation beyond his control.

2. According to the petitioner, even if a student is absent for an examination, the same must be considered as non-appearance for the examination in which, the student fails. To support this contention, Page No.3/6

Clause 18.4 of the Anna University Regulations has been relied upon. Therefore, a student, who fails to secure a pass in a Studio Course due to his absence during examination, should also be permitted to take the supplementary viva voce examination as per Clause 11.2.2 of the Regulations. The grievance of the petitioner is that this supplementary viva voce examination was not conducted and as a result of the same, the petitioner is not allowed to attend the 6th Semester classes. The issue raised by the petitioner requires consideration.

3. Without prejudice to the rights of either parties, in the interest of the student, the petitioner shall be permitted to attend the on-line classes until further orders.
