ORDER

This writ petition has been filed to forbear respondents 1 to 4 from issuing a separate Patta for the property, morefully disclosed in the prayer to this writ petition in favour of the fifth respondent, based on the petitioner's representation dated 29.01.2026.

2.The petitioner claims that the fifth respondent is not entitled for the grant of Patta in her name for the property, morefully disclosed in the affidavit filed in support of this writ petition. According to the petitioner, despite pendency of the Civil Suit namely, O.S. No.232 of 2022 on the file of the Additional District Court, Hosur between the parties namely, the petitioner and the fifth respondent, the fifth respondent is now attempting to get Patta in her name for the property, morefully disclosed in the affidavit filed in support of this writ petition. In such circumstances, the petitioner had given a representation on 29.01.2026 to respondents 1 to 4 to forbear them from issuing separate Patta in favour of the fifth respondent for the property, morefully disclosed in the prayer to this writ petition. Since the said representation was not considered, the petitioner has filed this writ petition.

3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of respondents 1 to 4. Since no adverse orders are being passed against the fifth respondent, notice to the fifth respondent is dispensed with by this Court.

4.Necessarily, the objections of the petitioner as raised in his representation have to be considered by the competent authority whenever any application is submitted by any party seeking for grant of Patta in respect of the property, which is the subject matter of the petitioner's representation dated 29.01.2026. In the instant case, the petitioner claims that the fifth respondent is attempting to get patta in her name for the property, morefully disclosed in the affidavit filed in support of this writ petition, despite pendency of the civil suit between the petitioner and the fifth respondent in O.S. No. 232 of 2022 on the file of the Additional District Court, Hosur. 5.This Court is not expressing any opinion on the merits of the petitioner's objections as raised in the petitioner's representation dated 29.01.2026 given to the official respondents. The said objections will have to be considered by respondents 1 to 4 whenever any application is submitted by the fifth respondent seeking for grant of Patta in her favour for the very same property.

6.For the foregoing reasons, this writ petition is disposed of by directing the 4th respondent to consider the objections raised by the petitioner through his representation dated 29.01.2026 with regard to the issuance of Patta in respect of the subject property whenever any application is submitted by the fifth respondent or any other party seeking for grant of Patta in their name and only thereafter the fourth respondent shall consider the grant of Patta for the fifth respondent or any other party. Consequently, connected WMP is closed. No costs.
