Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Appeal No.658/2017 on the file of the High Court, the High Court will be pleased to suspend the sentence imposed on the petitioner by learned Special Judge, (Special Court for trail of cases under the prevention of corruption Act), Ariyalur in Spl. C.No. 06 of 2012 dated on 04.10.2017. Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl. Appeal No.658/2017 on the file of the High Court and upon hearing the arguments of M/S.R.SIVARAMAN, Advocate for the petitioner and of MR.P.GOVINDARAJAN ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- Seeking to suspend the sentence imposed on the petitioner by the learned Chief Judicial Magistrate/ Special Judge, Ariyalur in Spl.Case No.06 of 2012 dated 04.10.2017 u/s 8 and 12 of Prevention of Corruption Act 1988 and enlarge the petitioner on bail, the petitioner is before this Court with this petition.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
3. The petitioner / A-2 is a document writer and was found guilty by the trial Court for the offence committed under Sections 8 and 12 of Prevention of Corruption Act 1988. He was sentenced to undergo five years simple imprisonment and to pay a fine of Rs.5,000/- in default of payment of fine, to undergo further one year simple imprisonment under Section 8 of Prevention of Corruption Act 1988 and to undergo five years simple imprisonment and to pay fine of Rs.5,000/- in default of payment of fine, to undergo further one year simple imprisonment under Section 12 of the said Act.
4. Considering the ground of appeal raised in the appeal, sentence alone is suspended on condition that:- (i) The petitioner/A-2 shall execute a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Chief Judicial Magistrate/ Special Judge, Ariyalur. (ii) The petitioner/A-2 shall appear before the Chief Judicial Magistrate Judge, Ariyalur on the 10th day of every English calendar month at 10.30 a.m until further orders.
