ORDER

The petitioners, who apprehend arrest for the alleged offence under Section 303(2) of BNS Act, 2023 r/w. Section 21(1) of Mines and Minerals (Development & Regulation) Act, 1957 in Crime No.230 of 2025 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioners alleged to have found in illegal possession of 4 units of pebbles.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that there are three previous cases against the first petitioner and five previous cases against the second petitioner and hence, he opposed to grant anticipatory bail to the petitioners.

5. Considering the submission of the learned Government Advocate, this Criminal Original Petition is dismissed.
