O R D E R

This Criminal Original Petition has been filed to transfer the investigation in connection with Crime No.582 of 2015 on the file of the 3rd respondent to 4th respondent herein.

2. The learned counsel for the petitioner submitted that despite complaint given to the third respondent with regard to theft of jewels, no progress has been made for the past seven years. Hence he prayed to transfer the investigation from the third respondent to fourth respondent.

3. The learned Additional Public Prosecutor appearing for the respondent police would submit that investigation has been completed and negative report would be filed by the respondent police as early as possible and also they would serve RCS Notice on the petitioner. Page No.2 of 5

4. Heard both sides.

5. In view of the above submission made by the learned Additional Public Prosecutor, the respondent police is directed to file the negative report as expeditiously as possible and serve the RCS notice on the petitioner within a period of one month from the date of receipt of a copy of this order and on such service the petitioner is at liberty to file protest petition or a private complaint before the concerned Magistrate Court or even seek further investigation in this regard.

6. With the above direction the Criminal Original Petition is disposed of.
