This petition is filed under Section 439(2) of Cr.P.C. praying to cancel the bail granted in Crl.OP.No.3748 of 2019 ordered on 12.02.2019 by this Hon'ble Court in Cr.No.479 of 2019 on the file of the Inspector of Police, EDE II Team IV,Central Crime Branch, Chennai.
2. It is stated that the defacto complainant has filed the present petition seeking to cancel the anticipatory bail granted to the first respondent herein.
3. It must be stated that the first respondent was A1 in Cr.No.479 of 2018, registered by the second respondent for offences punishable under Sections 465, 467, 468, 471 and 420 of IPC. Thereafter, anticipatory bail had been granted to the first respondent.
4. Let me not enter into a detailed discussion of the facts, particularly, because the second respondent after investigation had filed final report which had been taken cognizance as C.C.No.17291 of 2022 and it is now pending for framing of charges before the Special Court for trial of CCB cases at Egmore in Chennai.
5. In view of that particular development, it would only be appropriate that the petitioner herein /defacto complainant concentrates on tendering admissable evidence to assist the prosecution in their endeavour to prove the charges beyond reasonable doubt as against the accused persons.
6. The facts have to be tested during the course of trial. Therefore, this Criminal Original Petition stands dismissed without entering into any discussion on the merits of case.
