Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the respondent to consider the petitioner's representation dated 25.04.2015 and consequently transfer the petitioner as Nursing Superintendent Grade-II in Annal Gandhi Memorial Government Hospital, Trichy Attached to K.A.P.Vishvanathan Medical College, Trichy in the next vacancy.

ORDER

The present writ petition has been filed for a Mandamus, to direct the respondent to consider the petitioner's representation dated 25.04.2015 and transfer her as Nursing Superintendent Grade-II in Annal Gandhi Memorial Government Hospital, Trichy attached to K.V.P. Vishvanathan Medical College, Trichy in the next vacancy. 2.According to the petitioner, she was appointed as a Staff Nurse on 03.03.1983 at Tanjavur Government Hospital. She was subsequently transferred to Annal Gandhi Memorial Government Hospital, Trichy on 25.06.2008. She was promoted as a Nursing Superintendent Grade-II on 18.08.2012 and transferred to Government https://hcservices.ecourts.gov.in/hcservices/

Periyar Hospital, Mayiladuthurai. Thereafter, on 01.08.2013, she transferred to Government Hospital, Thiruvarur attached to Government Medical College, Thiruvarur. It is the case of the petitioner that she is spending 8 hours a day for travelling by bus from Trichy to Thiruvarur and back. The petitioner, on coming to know that a vacancy is likely to arise in Annal Gandhi Memorial Government Hospital, Trichy, made a presentation dated 25.04.2015 to the respondent to transfer her to the said place in the next vacancy. However, no order was passed by the respondent till date. Hence, the present writ petition has been filed for the relief stated supra. 3.I have heard the learned counsel for the petitioner and the learned Government Advocate, who took notice on behalf of the respondent.

4.Considering the narrow scope of the prayer made in this writ petition, which is to direct the respondent to consider the representation of the petitioner dated 25.04.2015, without going into the merits of the averments made in the affidavit of the petitioner as well as the representation, this Court direct the respondent to dispose of the representation of the petitioner dated 25.04.2015, on merits and in accordance with law, within a period of one month from the date of receipt of a copy of this order.

5.This writ petition is disposed of with the above direction. No costs.
