PRAYER: The Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, forbearing the 2nd respondent from appointing the 5th respondent as Principal (Incharge) to the 4th respondent college. The petitioner has challenged the order of adhoc appointment of the 5th respondent to the post of Principal on the ground that the 5th respondent does not posses the necessary educational qualification prescribed by UGC as well as NCERT. https://hcservices.ecourts.gov.in/hcservices/
2. During the pendency of the writ petition, the 5th respondent attained the age of superannuation and retired from service. Now that some other person is appointed as Principal in full additional incharge. The writ petitioner has also filed another writ petition in W.P.No.16961 of 2020. In view of the retirement of the 5th respondent, no further relief can be granted against him as he has already vacated the post of Principal incharge. Therefore, nothing survives for adjudication in this writ petition. Accordingly, this writ petition is dismissed as infructuous. Consequently, connected miscellaneous petition is closed. No costs.
