This application has been filed seeking to set aside the exparte order dated 01.11.2023 passed against the defendant in the above suit.

2. It is the contention of the defendant that at the time of passing the exparte order, he was working in abroad and was not in India. Therefore, he could not contact his advocate. Hence, seeks to allow this application for setting aside the exparte order dated 01.11.2023.

3. Written statement is filed along with an application for condoning delay in filing the written statement. Considering the fact that suit itself is filed for recovery of money, this Court in order to give fair opportunity to the defendant to agitate his rights on merits, is inclined to set aside the exparte order dated 01.11.2023.

4. Post on 12.04.2024, for framing issues.
