Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records of the first respondent relating to the Circular dated 11.08.2015 sent to the Chairman, All Major Port Trusts regarding filling up of direct recruitment vacancies in Major Port Trusts, and the consequential 4th respondent's notification under File No.A1/009/2015/GA dated 22.11.2015 inviting application for filling up the vacancies vide Paper Publication dated 22.11.2015 in so far it relates to direct recruitment for each one post of Asst. Executive Engineer (Mechanical) Class I and Asst. Executive Engineer (Electrical) Class I and quash the same as illegal and without jurisdiction and further direct the 1st and 2nd respondents to promote the petitioners the engineering Degree holding Asst. Engineer Class II from the date of vacancy arose under direct recruitment for the post of Asst. Executive Engineer Class I both in Mechanical and Electrical. For Petitioners :

O R D E R

When the matter was listed on 02.12.2024, the following order has been passed:- "Learned counsel for the respondents submits that the petitioners had challenged the selection notification and for consequential relief for promoting them to the post of Assistant Executive Engineer. During the pendency of the writ petition, the third petitioner had retired on 30.06.2019 and all the other petitioners have been promoted to the post of 2/5

Assistant Executive Engineer and therefore, nothing survives for adjudication in this petition. Since there is no representation for the petitioner, list the matter under the caption 'for orders' on 03.12.2024." 2.

Today, when the matter is taken up for hearing, the learned counsel appearing for the petitioner submitted that the relief sought for in the present writ petition has become infructuous and he has also made an endorsement to that effect.

Recording the submission and endorsement made by the learned counsel appearing for the petitioner, this Writ Petition is dismissed as infructuous. Consequently, connected Miscellaneous Petitions are closed.

There shall be no order as to costs.
