ORDER

This Writ Petition is filed seeking to issue a Writ of Mandamus directing the respondent to consider and dispose of the representation made by the petitioner on 01.05.2023 to the 1 st respondent thereby requesting them to correct the classification of the land which is in the petitioner's possession as Gramanatham earlier to the UDR in Old S.No.300/1 at Edamachi Village, Uthiramerur Taluk, Kancheepuram District, now changed as road by issuing a new Survey number as 397/7, within a time frame.

2. The learned counsel for the petitioner submitted that the subject land was an house site and subsequently, during UDR, the classification of the land was changed as Road. Even the Village Administrative Officer who had visited the property, has given a certificate in the year 2005 that the said property is a Gramanatham and possessed by the petitioner viz. S.Ranganathan from his ancestral.

3. Mr.A.Selvendran, learned Special Government Pleader takes notice for the respondents.

4. It is to be noted that the UDR scheme is prior to 1985. Now we are in the year 2024. The property has been classified as road and used as road for about 40 years. The petitioner has not made any objection from the year 1984 till 2023 and he has made the representation only on 01.05.2023. Therefore, the petitioner is not entitled to the relief sought for.

5. Therefore, this Writ Petition is dismissed. No costs.

6. However, the petitioner is at liberty to work out his remedy in the manner known to law before the competent Court. 28.03.2024 Index : Yes / No Speaking Order : Yes / No ksa-2 3/5
