A.Nos.2504 and 2505 of 2018 C.V.KARTHIKEYAN, J., Both these applications have been filed seeking an order on behalf of the 5th defendant to collect amount including arrears from the 19 traders and also to permit the 5th defendant to maintain, carry out request and put up construction over the suit schedule mentioned properties.

2. Heard, Mr.S.R.Ragunathan, learned counsel for the applicant/5th defendant and Mr.T.V.Ramanujam, learned senior counsel for the respondent/plaintiff. It has been stated that a comprehensive order regarding payment of rent has been passed in O.A.No.513 of 2017, by order dated 06.06.2018. It is also represented that as against the said order, an Original Side Appeal was filed and the same has also been dismissed by the Division Bench. It is also stated by the learned counsel for the applicant that amounts have been deposited by the Court and he placed a request that the direction be issued to the respondent/plaintiff to withdraw the said amount and pay the same directly to the present http://www.judis.nic.in 1/2

applicant.

C.V.KARTHIKEYAN, J., ub The said direction cannot be issued in these Applications. The applicant/5th defendant may workout his remedies in appropriate manner.
