PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the order in Proc.No.B2/29036/2012 dated 19.10.2012 and Ref.No.B2/41903/2012 dated 26.10.2012 issued by the 1st respondent in so far as inclusion of the respondents 2 to 4 in the panel and consequential promotion as Forest Ranger and quash the same, being unqualified persons in terms of Tamil Nadu Forest Subordinate Service Rules and issue suitable direction to the 1st respondent to promote the petitioner as Forest Ranger on par with his juniors, with all attendant benefits. O R D E R

This writ petition is filed calling for the records relating to the order in Proc.No.B2/29036/2012 dated 19.10.2012 and Ref.No.B2/41903/2012 dated 26.10.2012 issued by the 1st respondent in so far as inclusion of the respondents 2 to 4 in the panel and consequential promotion as Forest Ranger and quash the same, being unqualified persons in terms of Tamil Nadu Forest Subordinate Service Rules and issue suitable direction to the 1st respondent to promote the petitioner as Forest Ranger on par with his juniors, with all attendant benefits.

2. Today counter affidavit has been filed by learned counsel for the respondent and it has been stated that the petitioner has been promoted as Forest Range Officer, the relevant portion is extracted below:- "Hence, the contents made by the petitioner are not correct. Further, it is respectfully submitted that the petitioner has been promoted, vide Prinicpal Chief Conservator of Forests (Head of Forest Force) Proc. No.B2/24281/13/ dated 26.07.2013, as Forest Range Officer, in the temporary panel 2012-13, drawn subsequent to the main panel discussed above after relaxing the mandatory years of service from 8 years to six years. And now he is working as Forest Range Officer."

3. In view of the above, nothing survives in this present petition and 2/4

the Writ Petition stands disposed of. Connected miscellaneous petition is closed. No costs.
