PRAYER:Writ petition filed under Article 226 of the Constitution of India for issuance of a writ of mandamus to direct the first respondent to consider the petitioner representation dated 13.10.2017 requesting to cancel the patta issued in favour of the second respondent in respect of lands in No.656/A of Jaggupatti Taraf, Pochampalli Taluk, Krishnagiri District. For Petitioner : Mr.K.Thiruvengadam For Respondents : Mr.R.Govindasamy for R1 Special Government Pleader Notice to R2 is dispensed with.

O R D E R

Mr.R.Govindasamy, learned Special Government Pleader takes notice for the first respondent. Since this writ petition is disposed of without passing any positive direction against the second respondent, notice to the said respondent is dispensed with.

2.The petitioner seeks for a mandamus to direct the first respondent to consider the petitioner representation dated 13.10.2017, requesting to cancel the patta issued in favour of the second respondent in respect of lands in No.656/A of Jaggupatti Taraf, Pochampalli Taluk, Krishnagiri District. 3.It is seen from the facts narrated before the Court in the affidavit filed in support of the petition that the petitioner has not approached the original Authority viz., the Tahsildar of the concerned Taluk and on the other hand, had gone to the Revisional Authority viz., D.R.O, straight away and given the said representation. Therefore, this Court is of the view that the said representation cannot be given by-passing the original authority viz., Tahsildar.

Therefore, liberty is granted to the petitioner to give appropriate application before the concerned revenue official viz., the Tahsildar of Pochampalli Taluk.

interested, if any. By granting such liberty and making such observation and direction as stated supra, this writ petition is disposed of accordingly. No costs.
