ORDER

This writ petition has been filed seeking to Direct the respondent herein to settle the difference in Medical Leave Salary of 170.5 days of Medical Leave Salary to the 1st petitioner herein and 139.5 days of Medical Leave salary to the 2nd petitioner herein with 6 percentage interest, in view of G.O(MS) No 220, Transport (C1) Department dated 06.08.1999 and in the light of the orders passed by this Hon'ble Court in W.P.No.25068 of 2024 dated 02.09.2024 and by considering the representation of the 1st petitioner dated 05.11.2025 and 2nd petitioner dated 01.11.2025.

2.The case of the petitioners is that they were working in the respondent corporation and retired from service after attaining the age of superannuation. The grievance of the petitioners is that they were not paid the Medical Leave Salary as per G.O.(MS)No.220, Transport (C1) Department dated 06.08.1999 and thus sought for payment of difference in Medical Leave salary along with 6% interest. 3.Heard the learned counsel for the petitioners and the learned standing counsel appearing for the respondent and perused the materials available on record. 2/4

4.Taking into consideration of the aforesaid facts and circumstances of the case, the respondent is directed to pay the eligible amount payable to the petitioners towards the difference in Medical Leave Salary along with interest at the rate of 6% per annum for the delay period in view of G.O.Ms.No.220 dated 06.08.1999 and the order passed by this Court in W.P.No.25068 of 2024 dated 02.09.2024 within a period of six weeks from the date of receipt of a copy of this order. It is made clear that if the amount is not paid within a time frame fixed by this court, it will fetch an interest at the rate of 12% per annum from the date on which the amount become due and payable till the date of actual realisation. The petitioners are directed to submit a fresh representation to the respondent along with a copy of this order.

5.Accordingly, this writ petition is allowed with the aforesaid directions. No costs.
