ORDER

This Writ Petition has been filed challenging the impugned letter dated 12.02.2026 sent by the respondents 3 and 4, calling upon the petitioner to appear for an enquiry on 20.02.2026 in compliance with the directions issued by this Court in W.P. No. 43535 of 2025, etc., batch filed by fifth respondent.

2. The fifth respondent had sought for issuance of patta in his name for the very same property, which is also the subject matter of this writ petition. It was made clear in the common order dated 17.11.2025 passed by this Court in a batch of writ petitions, including the petition filed by the fifth respondent, that all the rival claimants will have to be heard before surveying and demarcating the boundaries by the Tahsildar.

3. The petitioner apprehends that, without hearing his objections, the respondents 3 and 4 may grant patta in favour of the fifth respondent. Necessarily, the respondents 3 and 4 will have to strictly comply with the directions issued by this Court on 17.11.2025 in the batch of writ petitions in

W.P. No. 43535 of 2025, etc., batch and the property, which is the subject matter of this writ petition was also one of the properties, which were the subject matter of the batch of the writ petitions disposed of by this Court on 17.11.2025.

4. The petitioner claims that he is the owner of the property, which is the subject matter of this writ petition. The same is disputed by the fifth respondent, who is also represented by a learned counsel.

5. For the foregoing reasons, this Writ Petition is disposed of by directing the respondents 3 and 4 to strictly comply with the directions issued by this Court in the batch of writ petitions, namely W.P. No. 43515 of 2025, etc., batch dated 17.11.2025 by hearing the objections of the petitioner and only thereafter, decide as to whether the respondents 3 and 4 can survey and demarcate the boundaries of the property, which is the subject matter of this writ petition.

6. The petitioner is also permitted to submit his written objections to the respondents 3 and 4, opposing the survey and demarcation of boundaries by the respondents 3 and 4 based on the request made by the fifth respondent, within a period of one week from the date of receipt of a copy of this order and necessarily, the respondents 3 and 4 will have to consider the same and only

thereafter take a final decision as to whether the survey and demarcation of the boundaries of the property morefully described in the prayer to this writ petition can be conducted or not based on the request made by the fifth respondent. No Costs. Consequently, connected writ miscellaneous petitions are closed.
