O.P.Nos.495 & 616 of 2019 N.SATHISH KUMAR, J.

The matter relates to the enforcement of the contract. The petitioner has filed O.P.No.495 of 2019 challenging the award directing the petitioner to pay the advance amount with interest and the expenses said to have been incurred by the respondent.

Whereas, the respondent has filed O.P.No.616 of 2018 challenging the award passed by the arbitrator in negativing the relief of specific performance.

2. After hearing the parties, when the Court posed a question as to why the matter cannot be settled, since the amount of advance has not been disputed, the lerned counsel for the petitioner in O.P.No.495 of 2018, submitted hat he is ready to deposit a sum of Rs.3 crores towards advance and also Rs.One crore towards expenses.

3. The learned counsel appearing for the respondent submitted that he will take instructions in this regard and revert back.
