Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Mandamus, directing the respondent to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.07.2021 to 25.03.2023, in paying the amounts paid towards his terminal benefits namely EPF Employee's Contribution, Gratuity, Encashment of Leaves and VRS compensation, within a time frame as may be fixed by this Court and without affecting his right to claim balance amounts towards those benefits.

O R D E R

This Writ Petition has been filed in the nature of a Mandamus, seeking a direction against the respondent to pay interest for the belated payment of his terminal benefits namely EPF Employee's 1/4

Contribution, Gratuity, Encashment of Leaves and VRS compensation. The petitioner had given a representation on 10.01.2025.

In the affidavit filed in support of the writ petition, it is stated that the petitioner joined the respondent Transport Corporation as 'Conductor' on 17.10.1991 and after completion of 20 years of service, he voluntarily retired form service on 30.06.2021 (VRS). According to the petitioner, the terminal benefits were disbursed with a delay and he now seeks interest for the delayed period.

3. A direction is therefore issued to the respondent to examine the petitioner's Service Register and verify the date when the amount was disbursed. If it is found that the amount was disbursed with delay, interest at the rate of 6% per annum shall be granted from the date of retirement until the actual date of disbursement. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition stands 2/4

disposed of. No costs.
