Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 to measure the patta land belonging to the petitioner measuring about 82 cents comprised in Survey No.81/3 in Gudimallur Village, Walajah Taluk, Vellore District. O R D E R
The prayer sought for herein is for a writ of mandamus, directing the respondents 1 to 3 to measure the patta land belonging to the petitioner measuring about 82 cents comprised in Survey No.81/3 in Gudimallur Village, Walajah Taluk, Vellore District.
2. The petitioner, in order to measure the land in question filed this writ petition seeking the aforesaid prayer of mandamus.
3. In response to the same, on behalf of the official respondents, the Tahsildar, Walajah Taluk, filed a counter affidavit, dated 14.03.2017, wherein inter alia, the Tahsildar has stated that, the land in question which is sought to be measured by the petitioner has already been measured in the year 2015 itself and accordingly, separate patta to S.No.81/3A3 in patta No.539 was given to the petitioner and the petitioner had also acknowledged the same. Therefore relying upon the same, the learned counsel for the Government appearing for the respondents submitted that, the prayer sought for by the petitioner has already been accomplished in the year 2015 itself, therefore nothing survives in this writ petition.
4. The said position is not controverted by the learned counsel appearing for the petitioner who also would submit that, he has received instruction from the petitioner that the prayer has been accomplished.
5. In view of the above, recording the aforesaid development, as no further order is required to be passed in this writ petition, accordingly, this writ petition is dismissed. No costs.
