ORDER

This petition is filed to quash the FIR in Crime No.19 of 2026, on the file of the 1st Respondent .

2.The learned counsel for the second respondent strongly opposed this petition, stating that the petitioner is the root cause of the entire case. It is contended that the petitioner and other accused have used abusive and prohibitive language against the defacto-complainant, hence, lodged a complaint was lodged.

3. The learned Additional Public Prosecutor appearing for the first respondent submitted that the petitioner's social status was verified revealing that the petitioner also belongs to the SC/ST community. Consequently, the case against her under Section 3 (1) (s) of SC/ST (Prevention of Atrocities) Act, 1989 cannot proceed. She further submitted that on the complaint of the defacto-complainant investigating commenced, eleven witnesses were examined and their statements recorded. It was found that the allegations were exaggerated and the case has been closed as mistake of Fact. The closure report No.RCS08/D2PS/CBC(c)/26 has been served to the second respondent and the proof of the same is also produced.

4.In view of the above submission, nothing survives for further consideration. Accordingly, this petition is closed. Consequently, connected Criminal Miscellaneous Petition stands closed. The second respondent is at liberty to file a protest petition before the concerned Court. It is for the concerned court to decide the protest petition on merits. 21-04-2026 ep To
