O R D E R

The petitioner who is the defendant in O.S.No.151 of 2012, challenges an order, dismissing his application in I.A.No.114 of 2018 seeking to reopen his evidence which was closed. 1/4

2. The learned trial Judge had dismissed the application by a cryptic order. It is however stated by the learned counsel for the respondent that after the dismissal of I.A.No.114 of 2018, the petitioner had filed an application for amendment in I.A.No.719 of 2019 which has been allowed and the said order allowing the amendment application is the subject matter of challenge in the Civil Revision petition in CRP No.280 of 2020. This Court has also stayed all further proceedings in the suit in O.S.No.151 of 2012, pending the Civil Revision petition.

3. In view of the said statement, there is no necessity for me to go into the merits of the revision, except to observe that if the revision against the amendment application is dismissed and the amendment is carried out, the defendant will automatically have an opportunity let in evidence. If the revision is allowed and the amendment application in I.A.No.718 of 2019 is dismissed, it will be open for the defendant to renew the request for reopening of the evidence.

4. The Civil Revision petition is disposed of with the above observations. No costs. Consequently, connected miscellaneous petition is closed.
