ORDER

This writ petition has been filed for issue of writ of mandamus directing the 1 st respondent to deal with the representation made by the petitioner on 20.03.2023, wherein, the petitioner is seeking for cancellation of the fraudulent documents that were registered on the file of the 4 th respondent.

3/6 2.Heard Mr.P.Santhosh, learned counsel appearing on behalf of the petitioner and Mr.R.Sasikumar, learned Government Advocate appearing on behalf of respondents 1 to 4.

3.In the considered view of this Court, the registering authority do not have any power to cancel the registered document, since Section 77A of the Registration Act has already been held to be unconstitutional by the Division Bench of this Court in M.Kathirvel vs. The Inspector General of Registration, Department of Registration and others reported in 2024 4 CTC 769. 4.In view of the above, it is left open to the petitioner to workout her remedy before the competent Civil Court and seek for the appropriate relief. Except giving this clarity, no further orders can be passed in this writ petition.
