ORDER : The Court Made the following order :- The petitioner who apprehends arrest for the alleged offence under Section 379, 430 IPC & 21(1) of Mines and Minerals (Development & Regulation Act, 1957) in Crime No.529 of 2021 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused persons were involved in illegal transportation of 2 units of river sand in a lorry. Hence this complaint.
3. The learned counsel appearing for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.
4. The learned Government Advocate (Crl. Side) submits that this is the 3rd anticipatory bail petition and the earlier bail petitions filed by the petitioner were dismissed by this Court on 06.10.2021 and 03.01.2022. He further submitted that, petitioner along with https://hcservices.ecourts.gov.in/hcservices/
other accused persons illegally transported 2 units of river sand by using lorry without any valid permit. Hence, he opposed for grant of anticipatory bail to the petitioner.

In view of the submission made by the learned Government Advocate (Crl.Side), and since there is no change of circumstances for considering the 3rd anticipatory bail petition filed by the petitioner, this Criminal Original petition is dismissed. -sd/- 28/04/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
