ORDER

This writ petition has been filed, challenging the impugned proceedings dated 03.11.2020 passed by the seventh respondent, granting patta for the

property morefully described in the prayer to this writ petition in favour of the private respondent viz., R16 to R18.

2. Admittedly, aggrieved by the impugned proceedings dated 03.11.2020, the petitioner had already filed an appeal before the fourth respondent on 04.01.2021 and the said appeal is pending on the file of the fourth respondent. The petitioner claims that subsequent to the impugned proceedings, with the aid of fabricated and forged documents, the private respondents viz., the respondents 16 to 18 have registered a settlement deed. If the petitioner is confident of success in the appeal pending on the file of the fourth respondent, the petitioner should have to agitate all their grievances that have been raised in this writ petition before the fourth respondent.

3. The petitioner claims that being a senior citizen, he was compelled to file this writ petition. The interest of all the parties will be protected if a direction is issued to the fourth respondent to dispose of the petitioner's appeal dated 04.01.2021, aggrieved by the impugned proceedings dated 03.11.2020 within a time frame to be fixed by this Court since the appeal is pending from 2021 onwards.

4. At this stage, after a lapse of almost six years from the date of receipt of the impugned proceedings, this Court cannot entertain this writ petition. The

only limited relief that can be granted to the petitioner is to direct the fourth respondent to dispose of the petitioner's appeal dated 04.01.2021, aggrieved by the impugned proceedings dated 03.11.2020 within a time frame to be fixed by this Court.

5. Accordingly, this writ petition is disposed of by directing the fourth respondent to dispose of the petitioner's appeal dated 04.01.2021 on merits and in accordance with law by adhering to the principles of natural justice within a period of twelve weeks from the date of receipt of a copy of this order. No costs. Consequently, W.M.P.
