Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the entire records connected with the impugned order passed by the third respondent dated 03.06.2015, terminating the service of the petitioner as Sanitary Worker coupled with order of recovery and quash the same and consequently direct the respondents to reinstate the petitioner into service as Sanitary Worker with all consequential monetary benefits.

The learned counsel for the petitioner is not present before this court. However, the petitioner, who is present before this court submitted that the petitioner is inclined to withdraw the writ petition provided the respondents waive the recovery proposed under the impugned proceedings dated 03.06.2015 and he has also made an endorsement to that effect.

2. Mr.Vadivelu Deenadayalan, learned Additional Government Pleader representing the Respondent No.1, on instructions from the officers who are present before this court submitted that, the respondents are ready to waive the recovery proposed against the petitioner under the impugned proceedings dated 03.06.2015.

3. In the light of the above, the petitioner is permitted to withdraw the writ petition, insofar as the termination of his services under the impugned proceedings dated 03.06.2015 is concerned. However, the recovery proposed

through the impugned proceedings dated 03.06.2015 shall not be effected by the respondents.
