DHANABAKIYAM Writ petitions under article 226 of the Constitutions of India praying that in these circumstances stated therein and in the affidavit filed their with the High Court will be pleased to issue a writ or order or any other direction in the nature of a writ of mandamus directing the 1st respondent to give police protection for the petitioner to remove the fencing laid in the pathway to his property in S. F. NO. 279/2, 3, 5, 278/2 and 277/2 and pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice in WP.NO.10078 OF 2021.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.R.VENKATRAMAN, Advocate for the petitioner and of MR.MOHAMED RIYAZ, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondents the court made the following order:- It is seen that the petitioner has already filed a suit is O.S.No.956 of 2020 on 08.10.2020 seeking right over the common pathway, which is in dispute. It is also seen that the third respondent herein has also filed a suit in O.S.No.210 of 2021 for permanent injunction for the same property and also filed an IA.No.1 of 2020 seeking interim injunction. It appears that it is a civil dispute between the petitioner and the third respondent and the cases are pending before the Civil Court. https://hcservices.ecourts.gov.in/hcservices/

2. In view of the same, the petitioner is directed to approach the Civil Court and obtain necessary orders.
