ORDER
This writ miscellaneous petition has been filed by the petitioner seeking restoration of W.P.No.33025 of 2023, which was dismissed by this Court on 07.12.2023.
2. The petition in W.P.No.33025 of 2023 was filed to call for the records of the proceedings passed by the 4th respondent/Tahsildar in OPT Id No.2022/0105/05/191607 dated 24.04.2023 in rejecting the restoration of individual Patta No.2037 in favour of the petitioner and quash the same as illegal and violation of principles of natural justice and consequently directing the 4th respondent to modify/cancel the joint patta Number 2788 issued in Survey No.130 measuring an extent of 0.9.5 Ares (0.23 cents) granted in favour of the 5th respondent and his family members and including the petitioners name and his property of Survey No. 130/2 measuring an extent of 0.10 cents in the joint patta and restore the joint patta No. 2037 in the name of the petitioner.
3. On 07.12.2023, when the above writ petition came up for hearing, this Court dismissed the same by citing the reason that the petitioner has not served notice and not filed an Affidavit of Service for proof of serving the notice to the respondents.
4. Aggrieved over the same, the present miscellaneous petition has been
filed seeking the relief stated in the opening paragraph.
5. Heard the learned counsel for the petitioner and perused the materials available on record.
6. Today, when the matter was taken up for hearing, Ms.Usha Ramman, learned counsel for the petitioner submitted that at the time of passing final order in the above writ petition, he has taken steps by serving notice to the respondent, however, no proof was filed. Now, he has filed an affidavit of service along with the petition. Hence, he prays that the order dated 07.12.2023 may be set aside and the writ petition restored to file.
7. Satisfied with the above submissions made by the learned counsel for the petitioner and also considering the fact that the petitioner has filed an affidavit of service, this writ miscellaneous petition stands ordered and the order dated 07.12.2023 dismissing the writ petition is set aside and the writ petition in W.P.No.33025 of 2023 is restored to file.
8. List the writ petition in W.P.No.33025 of 2023 for hearing on 13.07.2026.
