Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 1st and 2nd respondents to inquire into and investigate the siphoning, diversion and misappropriation of various funds from any public sector banks, financial institutions, operational creditors and the resultant scam caused by the erstwhile Directors/Promoters of the 4th respondent company who are the direct/indirect beneficiaries,

whose accounts of the said company is being scrutinized by the 5th respondent.

This writ petition is filed seeking to direct the respondents 1 and 2 to inquire into and investigate the siphoning, diversion and misappropriation of various funds from any public sector banks, financial institutions, operational creditors and the resultant scam caused by the erstwhile Directors/Promoters of the 4th respondent company who are the direct/indirect beneficiaries, whose accounts of the said company is being scrutinized by the 5th respondent. When the matter is taken up today, the learned Special Public Prosecutor appearing for the respondents 1 and 2 would submit that the respondents 1 and 2 have not taken any action on the allegation contained in the complaint. He would further submit that by letter dated 29.03.2017 in reference No.C6/CAME12016E0017/39, they have forwarded the complaint to the Chief Vigilance Officer, State Bank of India, Mumbai-400021 for taking necessary action as it deems fit. He would further submit that by letter dated 16.042.019, the respondents have informed the petitioner that they have not taken any action on the complaint.

In view of the above, the writ petition is closed, granting liberty to the petitioner to proceed in accordance with law before the appropriate forum. No costs.
