Though the learned counsel for the 2nd and 3rd respondents would have very serious objection for condonation of delay, considering the reasons assigned in the affidavit filed in support of the petition and the length of the delay we deem it fit to allow this petition with a view to give opportunity to the appellant to prosecute the appeal on merits.

2. Hence, this petition is ordered and the delay of 38 days in filing the above appeal is condoned.
