PRAYER : Petition filed under Article 226 of Constitution of India for issuance of Writ of Mandamus directing the 1st Respondent to conduct the proceedings in SHRC Case No.8260 of 2016 and dispose the same within a time.

(Order of the Court was delivered by N.KIRUBAKARAN, J) This Petition has been filed seeking direction to the 1st Respondent to conduct the proceedings in SHRC Case No.8260 of 2018 and dispose of the same within a time.

2.The case of the Petitioner is that he has filed a complaint in SHRC.No.8260 of 2018 before the 1st Respondent against Respondents 2 and 3, who are all police officials for the alleged violation of human rights committed by them. Though the case has been filed in the year 2018, the same is yet to be disposed.

3.Heard Mr.T.Sushil Sarayu, learned counsel appearing on behalf of the Petitioner and Mr.T.C.Gopalakrishnan, learned standing counsel appearing on behalf of the 1st Respondent. Since this Court intends to pass orders to direct the 1st Respondent to dispose of the aforesaid case in time bound manner, no notice is necessary to Respondents 2 & 3, in fact, Respondents 2 & 3 will be benefited if the time limit is given to dispose of the case.

4.Taking into consideration that the alleged violation of human rights took place in the year 2018 and the case has also been filed in the year 2018 and the Petitioner is in the box for cross examination by Respondents 2 & 3, it is appropriate to direct the 1st Respondent to conclude the proceedings in SHRC No.8260 of 2018, on or before 31.10.2021, after giving sufficient opportunity of hearing to all the parties. 5.With the above directions, this Writ Petition is disposed of. No costs.
