under reference outward No.CIDCO/Navi Mumbai 70/2011 on the file of the 5th respondent and consequently the order in No.V-11014/4 Bn NDRF (A)/ Disc/CC/2011/7395 dated 21.9.2011 on the file of the 1st respondent and quash the same as illegal, arbitrary and without jurisdiction and thereby direct the respondents not to deduct the sum of Rs.15,000/- from the salary of the petitioner till the order is passed by the competent court for attachment of salary.

(Judgment of the Court was delivered by K.K. SASIDHARAN,J.) The learned counsel for the appellant made an endorsement that he is withdrawing the intra-court appeal with liberty to move the Court at Maharashtra to challenge the order passed by the Child Protection Officer under Section 9 of Protection of Women from Domestic Violence Act, 2005.

In view of the endorsement made by the learned counsel for the appellant, the intra-court appeal is dismissed as withdrawn with such liberty.
