A.No.5779 of 2016 in C.S.No.831 of 2016 K.KALYANASUNDARAM, J., This application is filed for prohibiting the 2nd respondent from cancelling the bank guarantee furnished by the 1st defendant in guarantee No.0479115FG0000122 for Rs.1,00,00,000/-.

2. The learned counsel appearing for the 1st respondent would submit that this Court has granted an order of interim injunction on 08.11.2016. But even before the order, the bank guarantee was cancelled, it got expired on 14.11.2016 and the 1st respondent has received the notice in this application only on 23.11.2016.

3. In view of the submissions made by the learned counsel appearing for the 1st respondent, this application is dismissed as infructuous.
