PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the first Respondent to 1/5

disposal petitioner's appeal dated 24.07.2020 against the order passed by the Third Respondent dated 08.06.2020 vide Na.Ka.No.33/2016/A3 and pass orders.

ORDER

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

2. The petitioner has filed this writ petition to disposal of the appeal filed by him on 24.07.2020 against the order passed by the Third Respondent dated 08.06.2020 vide Na.Ka.No.33/2016/A3 and pass orders.

3. The case of the petitioner is that she worked as Assistant in Adi Dravidar and and Tribal Welfare Office at District Collector Office at Thiruppur. Whileso two charge memos were issued to her, first memo 2/5

dated 07.05.2016 and another charge memo 17(b) dated 26.08.2016 alleging that she misused her official capacity and misappropriated funds of the respondent to the tune of Rs.1,40,000/- and she was suspended from services. Thereafter, an enquiry was conducted and she was removed from services on 08.06.2020 vide Na.Ka.No.33/2026., challenging the same the petitioner has filed an appeal before the first respondent. However the appeal has not yet disposed of. Aggrieved over the same the present writ petition has been filed.

4. The learned counsel for the petitioner submits that it would be suffice if the Court issues a direction to the first respondent to dispose of the appeal as early as possible.

5. The learned Government Advocate appearing for the respondents submits that the appeal will be disposed on merits and in accordance with law.

6. In view of the above, the first respondent is directed to provide 3/5

opportunity to the petitioner and dispose of the appeal within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, this writ petition is disposed of. No costs.
