PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the 2nd respondent to survey and sub-divide the property at Survey No.257/10E, Vadathorasalur, Kallakurichi Taluk, Kallakurichi District to an extent of 36 cents and consequently, issue patta for the same by considering the petitioner's representation dated 03.02.2021. ORDER

(The case has been heard through video conference) This Writ Petition has been filed seeking a direction directing the 2nd respondent to survey and sub-divide the property at Survey No.257/10E, Vadathorasalur, Kallakurichi Taluk, Kallakurichi District and issue patta for the same on considering the petitioner's application dated 03.02.2021.

2. The grievance of the petitioner is that he is the owner of property in Survey No.257/10E, Vadathorasalur, Kallakurichi Taluk, Kallakurichi District and he has made an application seeking for granting patta based on a civil court decree passed in his favour on 03.12.2020, for which, he has paid necessary fees. But, so far, it was not considered and no order has been passed on it. Hence, the present Writ Petition has been filed by the petitioner.

3. Considering the above circumstances, without going into the merits of the case, the 2nd respondent is directed to consider the petitioner's application dated 03.02.2021 and pass suitable orders on merits in accordance with law after hearing the petitioner within a period of twelve weeks from the date of receipt of copy of this order. Accordingly, this Writ Petition stands disposed of. No costs.
