ORDER

The petitioner, who was arrested and remanded to judicial custody on 10.06.2025 for the alleged offences under Sections 126(2), 296(b), 310(2) and

311 of B.N.S. in Crime No.726 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused waylaid the defacto complainant and demanded money at knife point. When the defacto complainant refused to give money, the accused abused him, assaulted and threatened him with dire consequences and the accused also snatched mobile phone from him. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that this is a put up case and he is ready and willing to abide by any condition that may be imposed by this Court and hence prayed to grant bail to the petitioner.

4. The learned Government Advocate (Criminal side) strongly objected to enlarge the petitioner on bail by stating that there are 5 other previous cases and out of which, two cases were registered under Section 302 of IPC and other cases are registered under Section 324 of IPC.

5. From the submissions made by the learned Government Advocate, it appears that the petitioner has been under incarceration since 22.12.2025 as he

involved in the offence of snatching of a cell phone. Though he has been under judicial custody for the past nearly two months, considering the fact that there are previous cases of gr nature, this Court is of the view that the petitioner is misusing the liberty granted to him by this Court and therefore, this is not a fit case to enlarge the petitioner on bail.

6. Accordingly, this Criminal Original Petition is dismissed. 06-03-2026 MJS Note:
