Writ petition filed under Article 226 of Constitution of India for issuance of writ of Certiorarified Mandamus calling for the records in the order no.CP-PU1/3855/2025-R2 dated 18.12.2025 passed by respondent no.2 and quashing the same, and directing the respondents to grant emergency leave for a 6 days by without escort for the petitioner's husband namely Karthik S/o Sugumar aged about 50 years, PID No.57101, Convict Prisoner, Central Prison, Puzhal, and pass such and thus render Justice. ORDER
(Order of the Court was made by Dr.Anita Sumanth J.) Read this order in continuation of and in conjunction with order dated 10.03.2026. Mr.Muniyapparaj, learned Additional Public Prosecutor points out today that impugned order dated 18.12.2025 is not one of rejection, as it only called for medical records proximate to the date of representation itself.
2. This is for the reason, he points out, that medical records that have been produced along with W.P.(Crl.)No.1698 of 2025 relate to the month of June and July, 2025, whereas the representation has been made in November, 2025.
3. Be that as it may, the authorities have now passed an order dated 10.03.2026 granting emergency leave to the convict for a period of six days, though with police escort.
4. Having regard to the submissions made and finding some merit in the submissions of Mr.Muniyapparaj, learned Additional Public Prosecutor today, no further orders are required in this matter.
5. The convict viz., Karthick, S/o Sugumar, aged 50 years, confined at Central Prison, Puzhal, Chennai, will be released on emergency leave for a period of six (6) days without escort i.e., from 12.03.2026. He shall be released on 12.03.2026 at 10.00 A.M. and the authorities shall seek return of the convict as per the extant Rules. The convict shall report before the Station in-charge, H8 Tiruvottiyur Police Station on every alternate day at 11.00 a.m., during the period of leave. During the leave period, the Convict Prisoner shall abide by all the conditions prescribed in the Jail Manual.
6. This Writ Petition and the connected Miscellaneous Petition are closed in the aforesaid terms.
