ORDER
This writ petition has been filed in a nature of Certiorari, seeking records on the file of the 1st respondent, the Secretary, Rural Development and Panchayat Raj Department, Chennai, in G.O.(D) No. 161 Rural Development and Panchayat Raj (PR-4) Department dated 18.04.2016 and to quash the same.
2.The writ petitioner was working as a president at Varakur Village Panchayat, Thimiri Panchayat Union, Vellore. By the impugned order,
reference was drawn to the charges which had been levied against the petitioner herein namely, that the petitioner had purchased hand pump spare parts without voucher and therefore, misappropriated a sum of Rs.1,26,000/- and further executed works in the panchayat without getting estimation and approval and thereby misappropriated a sum of Rs.2,30,359/- and the said work had been given in the name of her husband, R.Radhakrishnan and had purchased items for maintenance of panchayat without following Government Rules and tender quotation and therefore loss of Rs.2,25,600/- had been incurred and also passed resolutions without mentioning whether the same had been accepted or not. After following due procedure, the impugned order had been passed.
In the said order, directions had been given to initiate action under Section 205 of the Tamil Nadu Panchayat Act, 1994 against the petitioner herein. 3.The learned counsel for the petitioner stated that as on date, the term for which the petitioner enjoyed the post of President has long expired. Therefore, nothing survives for adjudication in the Writ Petition.
Accordingly, the Writ Petition stands dismissed. No costs.
